Service Agreement
The responsibility for providing plan participant plan and fee disclosures required under the Department of Labor ("Dol") ERISA §404(a) participant disclose regulation (Dol Regulation §2550.404a-5) is a plan sponsor responsibility. TIAA has provided information and a draft disclosure for complying with such regulation and accepts responsibility for the accuracy of information provided concerning TIAA annuities and its proprietary mutual funds. Information on non-proprietary funds offered under the plan has been provided by Morningstar® and TIAA is not responsible for the accuracy of such information. The Plan Sponsor understands that these draft disclosures are provided subject to Plan Sponsor review and that the Plan Sponsor is responsible for reviewing, approving and making any required changes to them before they are distributed to plan participants, eligible employees and beneficiaries.TIAA may not and does not provide legal or tax advice and recommends that the Plan Sponsor consult with its own attorneys and benefit advisors for such advice. As it relates to data provided by the plan sponsor to facilitate the preparation and/or delivery of 404(a) participant disclosures, TIAA shall use the participant data and any non-TIAA service provider data (the "Client Information") solely for the purpose of preparing and distributing 404(a) participant disclosures (the "Permitted Purpose"). TIAA shall not use the Client Information for any purpose other than the Permitted Purpose.
